Sometimes You Just Do Not Have A Choice!

Recently we were contacted by a retired businessman who had received a letter from a firm of Lawyers threatening to issue proceedings against him on the basis he had breached a restraint clause in relation to a business he had sold.

Having taken detailed instructions from the client our advice to him was that, in our opinion, he had not breached the restraint clause.

Legal proceedings were issued against our client who had little option but to defend his position. The matter eventually came on for hearing in the County Court of Victoria and ran for the best part of 9 days. The Trial Judge found in our client's favour.

Not happy with that decision, the unsuccessful Plaintiff appealed the decision to the Supreme Court, Court of Appeal. Again, the Court of Appeal found in favour of our client.

Finally, the Plaintiff made an application to have the matter dealt with by the High Court and for the third time, was unsuccessful.

Whilst there are occasions where it is simply best to avoid litigation, there are times where you have no option other than to issue or defend proceedings. When this occurs our team of litigation lawyers will ensure that you have first class representation.
